See Sound Live website and related services are owned and operated by 4S Medical Research P Ltd. Voca Spectrum and Voca Spectrum 3D applications have been developed by sensory app house limited and licensed to 4S medical Research P Ltd. Access and use of the Service is subject to the following Terms and Conditions of Service (Terms and Conditions). By accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms and Conditions including any future modifications. See

Description of Website and Service

SeeSoundLive empowers deaf kids and adults with the power of speech. Using SeeSoundLive, a deaf person can get a strong visual feedback of his own speech efforts. One by one, the user is able to develop speech clarity starting with simple sounds and moving to
more complex ones.

SeeSoundLive allows deaf people to use their naturally heightened visual processing skills to get a feedback of their speech efforts. Missing auditory feedback is the main reason why a deaf person cannot speak in spite of having a normal voice box. Visual feedback using
SeeSoundLive is similar to hearing with your eyes and is crucial in developing speech for the Deaf. Starting with simple sounds, deaf people can practice speaking more complex sounds and words over time.

SeeSoundLive has been developed by 4S Medical Research P Ltd. A team of Hearing & Speech experts, Software professionals, Artificial Intelligence and Machine Learning experts worked hard on the innovative proposal that a deaf person “can see sounds (visual
equivalents) instead of hearing them and use this feedback to develop speech.” Initial trials on children in deaf schools were very encouraging. What you are using now is the current version of See Sound Live, an evolving technology, which is a “must use” for deaf children and adults who want to develop oral speech in addition to sign language.

Using SeeSoundLive, in a matter of days you realise that you can start speaking 1 / 2 / 3 different sounds. How fast you then progress, depends on how much time you spend, trying to learn speaking simple sounds, and then more complex ones. Remember, a new born child takes up to two years to speak two words together. Time is not of essence, interest is.

See Sound Live is still evolving. From our experience so far, we feel confident that the product is safe and interesting to a child. Initial results with using See Sound Live in 10 year olds has been very encouraging.

However, since this technology is still evolving, we urge you to satisfy yourself completely about its value for yourself. 4S Medical Research P Ltd takes no responsibility for any issues surrounding See Sound Live such as usefulness, safety, etc.

Registration Submission of Content

You agree to provide accurate and complete information about yourself when requested by See Sound Live, to maintain confidentiality of your password and other security related information and to update any details when due.

Your Representations and Warranties

You represent and warrant to See Sound Live that your use of this service will be in accordance with these Terms and Conditions and all applicable laws, rules and regulations of India and any other jurisdiction that may apply to your location, including those regarding
online conduct, confidentiality and data.

Inappropriate Use

You will not display, record etc any content through this service that is defamatory, abusive, threatening, harassing, hateful, offensive or otherwise violates any law or infringes upon the right of any third party (including copyright, trademark, privacy, publicity or other personal or proprietary rights).

Indemnification

You agree to defend, indemnify and hold harmless 4S Medical Research P Ltd and its directors, officers, employees, contractors, agents, suppliers, licensors, successors and assigns, from and against any and all losses, claims, causes of action, obligations, liabilities and damages whatsoever, including attorneys’ fees, arising out of or relating to your access or use of the Service, any false representation made to us (as part of these Terms and Conditions or otherwise), your breach of any of these Terms and Conditions, or any claim that any translation we provide to you is inaccurate, inappropriate or defective in any way whatsoever.

License to Apps

Subject to these Terms and Conditions, See Sound Live grants you a non-transferable, non-exclusive license to download, install, and use one copy of each App in object code form only on a smart phone / computer that you own or control.

You may not derive or attempt to derive the source code of all or any portion of any App, permit any third party to derive or attempt to derive such source code, or reverse engineer, decompile, disassemble, or translate any App or any part thereof. See Sound Live and its licensors own and shall retain all intellectual property rights and other rights in and to the Apps, and any changes, modifications, or corrections there to.

In-App Purchases

You agree to pay all fees and applicable taxes incurred by you or anyone using a See Sound Live account registered to you. See Sound Live may revise the pricing for the goods and services offered through the Service at any time. All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.

Payment Processors

All financial transactions made in connection with the Service will be processed by a third party in accordance with their respective terms of use, privacy policy, and/or any applicable payment terms and conditions.

At no point in time, will See Sound Live be responsible for the actions or inactions of any third party payment processor, including, but not limited to, system downtime or payment service outages.

Refund Policy

At any point, if See Sound Live suspends or terminates your use of this service, or you close your account voluntarily, you agree that you will not receive any refund or exchange of any kind.

Third-Party Links, Sites, and Services

The Service may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by See Sound Live. We do not endorse or assume any responsibility for any such third-party sites, information, materials,
products, or services. If you access any third party website, service, or content from See Sound Live, you understand that these Terms and Conditions and our Privacy Policy do not apply to your use of such sites. You expressly acknowledge and agree that See Sound Live
shall not be responsible or liable, directly or indirectly, for any damage or loss arising from your use of any third-party website, service, or content.

The Service may include advertisements, which may be targeted to the Content or information on the Service, or other information. The types and extent of advertising by See Sound Live on the Service are subject to change. In consideration for See Sound Live granting you access to and use of the Service, you agree that See Sound Live and its third party providers and partners may place such advertising in connection with the display of content or information submitted by you or others.

IN NO EVENT WILL SEE SOUND LIVE BE LIABLE TO YOU OR ANY THIRD PARTY CLAIMING THROUGH YOU (WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHER THEORY) FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THE ACCESS OR USE OF, OR THE INABILITY TO ACCESS OR USE, THE SERVICE OR ANY PORTION THEREOF, INCLUDING BUT NOT LIMITED TO THE LOSS OF USE OF THE SERVICE, INACCURATE RESULTS, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR DAMAGES STEMMING FROM LOSS OR CORRUPTION OF DATA OR DATA BEING RENDERED INACCURATE, THE COST OF RECOVERING ANY DATA, THE COST OF SUBSTITUTE SERVICES OR CLAIMS BY THIRD PARTIES FOR ANY DAMAGE TO COMPUTERS, SOFTWARE, MODEMS, TELEPHONES OR OTHER PROPERTY, EVEN IF DUOLINGO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SEE SOUND LIVE’S LIABILITY TO YOU OR ANY THIRD PARTY CLAIMING THROUGH YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, IS LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO SEE SOUND LIVE FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE INITIAL ACTION GIVING RISE TO LIABILITY. THIS IS AN AGGREGATE LIMIT. THE EXISTENCE OF MORE THAN ONE CLAIM HEREUNDER WILL NOT INCREASE THIS LIMIT.

Termination

See Sound Live may terminate your access and use of the Service immediately at any time, for any reason, and at such time you will have no further right to use the Service. You may terminate your See Sound Live account at any time by following the instructions available through the Service. The provisions of these Terms and Conditions relating to the protection and enforcement of See Sound Live’s proprietary rights, your representations and warranties, disclaimer of representations and warranties, release and indemnities, limitations of liability and types of damages, ownership of data and information, governing law and venue, and miscellaneous provisions shall survive any such termination.

Proprietary Rights in Service Content

All content available through the Service, including designs, text, graphics, images, information, software, audio and other files, and their selection and arrangement (the “Service Content”), are the proprietary property of See Sound Live or its licensors. No Service Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, other than as expressly permitted in these Terms and Conditions. You may not use any data mining, robots, scraping or similar data gathering or extraction methods to obtain Service Content.

As between you and See Sound Live, all data, information and materials generated from your access and use of the educational activities made available on or through the Service, shall be exclusively owned by See Sound Live.

Trademarks, Copyright and Patents

SeeSoundLive and all other trademarks, service marks, graphics and logos used in connection with the Service are trademarks or service marks of 4S Medical Research P Ltd or their respective owners. Access and use of the Service does not grant or provide you with the right or license to reproduce or otherwise use the See Sound Live name, service marks, graphics or logos.

Information on the See Sound Live website and Apps is for personal use & may not be sold or redistributed. To reprint or electronically reproduce any document or graphic in whole or in part for any reason is expressly prohibited, unless prior written consent is obtained from See Sound Live. 

The Content is protected by copyright under both Indian and foreign laws. Title to the Content remains with See Sound Live or its licensors. Any use of the Content not expressly permitted by these Terms & Conditions is a breach of these Terms & Conditions and may violate copyright, trademark, and other laws. Content and features are subject to change or terminate without notice in the editorial discretion of See Sound Live. All rights not expressly granted herein are reserved to See Sound Live and its licensors. 

All content on the See Sound Live website and Apps including designs, text, graphics, pictures, information, applications, software, music, sound and other files, and their selection and arrangement (the “Site Content”) are the sole proprietary property of See Sound Live unless otherwise indicated. You do not have the right to modify, copy, perform, distribute, frame, reproduce, republish, upload, download, scrape, display, post, transmit, or sell in any form or by any means, in whole or in part, without See Sound Live’s prior written consent as they are protected under applicable copyright laws and treaty provisions (including but not limited to applicable intellectual property laws).

International Patent application for See Sound Live as a method and device to teach oral speech to deaf and hard of hearing kids and adults has been completed in 2019. (PCT/05081 2019) 

Privacy policy

Use of the Service is also governed by our Privacy Policy, a copy of which is located below. By using the Service, you consent to the terms of the Privacy Policy.

Our website’s and Apps’ registration and query may require users to give us personal information such as their name, email and demographic information such as their address and telephone number. The user’s personal information is used to contact the user as and when necessary. This personal information also allows us to inform the users about updates to the service and further additions on See Sound Live website and Apps. We collect personal information from user when they register on See Sound Live’s website or Apps, or when they submit a query to us. We maintain this information as private to the best of our ability.

Governing Law and Arbitration

These terms and conditions, its subject matter and See Sound Live’s and your rights under these Terms and Conditions, as well as and any claim, cause of action or dispute arising out of or related to these Terms and Conditions shall be finally settled under the rules of arbitration set out under the Indian Arbitration and Conciliation Act, 1996 or any statutory amendments/ modifications thereof by a sole arbitrator appointed by the Company. The place, venue and seat of arbitration shall be New Delhi only and all the arbitration proceedings shall be conducted in the English language. 

Judgment upon any arbitral award rendered hereunder may be entered in any court having jurisdiction, or application may be made to such court for a judicial acceptance of the award and an order of enforcement, as the case may be. 

Governing Law and Jurisdiction

All matters relating to See Sound Live shall be governed by and construed in accordance with Indian Law.

Language

This agreement was originally written in English. To the extent any translated version of this agreement conflicts with the English version, the English version controls.
